Terms of Service

1. The service

FlexShift provides shift-trading software to labor organizations ("Unions"). Each Union is the customer; its members ("Members") use the service under the Union's account. The service is provided "as is" during pilot periods.

2. Accounts & roles

Members join only through Union-issued invites. Unions control their members, branding, trade rules, and content. Union administrators are responsible for the accuracy of seniority and qualification data they manage.

3. Trades are facilitated, not guaranteed

FlexShift records trade postings, requests, and approvals between Members and the Union's administrators. The Union and its Members remain responsible for compliance with their collective bargaining agreement and employer policies. FlexShift does not modify official employer schedules; system-of-record entry remains the Union's responsibility.

4. Plans, add-ons & overage

Subscriptions bill monthly per the selected plan and add-ons. Consumption allowances (email/SMS) reset monthly; with a payment method on file a Union may opt into metered overage billing at the published rates. Fees are non-refundable except as required by law.

5. Text message (SMS) program

Members may opt in to receive shift-trade alert text messages from their Union, sent via FlexShift — notifications about new posts matching their alert settings, requests on shifts they've posted, trade approvals, and report-time reminders.

  • Opt-in only. Texts are sent solely to Members who provide their mobile number and actively check the consent box in Settings. Consent is not a condition of union membership or employment.
  • Message frequency varies based on the Union's trade activity and the Member's alert settings.
  • Message and data rates may apply, depending on the Member's mobile carrier plan.
  • Opting out: reply STOP to any message to cancel, or turn off text alerts in Settings. Reply HELP for help, or contact hello@flexshift.pro.
  • Carriers are not liable for delayed or undelivered messages. Delivery is subject to carrier network availability; FlexShift may modify or discontinue the SMS program with notice.
  • Mobile numbers and opt-in data are handled per our Privacy Policy — they are never shared with third parties or affiliates for marketing or promotional purposes.

6. Acceptable use

  • No attempts to access another Union's data or another Member's account.
  • No harassing, unlawful, or misleading content in posts, notes, or Union websites.
  • No automated scraping or bulk export except through provided export features.

7. Termination

Unions may cancel anytime; service continues to the end of the billing period. On termination, Union data is exportable for 30 days, then deleted per the Privacy Policy.

8. Liability

To the maximum extent permitted by law, FlexShift's aggregate liability is limited to the fees paid by the Union in the twelve months preceding the claim. FlexShift is not liable for missed shifts, scheduling disputes, or employer actions.
